Background Check & Eligibility Disclosure

This disclosure explains, in plain language, exactly what EarlyEd Reserve does and does not do with respect to background checks and eligibility to work in childcare in Texas. It is incorporated into the Educator Agreement and the Center Agreement.

1. What EarlyEd Reserve Is and Is Not

EarlyEd Reserve is an independent, private technology marketplace. It is not a licensing body, not a background-check provider, not a consumer reporting agency, not an employer, and not a government agency or contractor. EarlyEd Reserve does not conduct, run, order, obtain, or receive criminal background checks, and it does not make eligibility determinations.

2. What Centers Must Do

Every childcare operation remains solely responsible for completing its own required background-check and Centralized Background Check Unit (CBCU) processes for every educator it engages, through its own operation number, before confirming any assignment. An educator's participation in EarlyEd Reserve, profile content, badges, reviews, or any reported or recorded status never replaces, transfers, or satisfies that obligation.

3. What Educators Must Do

Educators must provide truthful information, upload genuine documents, and complete every step a center or the State of Texas requires of them — including fingerprints, forms, and in-person verification — when asked. Educators must immediately report to EarlyEd Reserve and to any engaging operation any change that could affect their eligibility to work in childcare.

4. What EarlyEd Reserve May Do

EarlyEd Reserve performs platform review only. We may review submitted documents for apparent validity and expiration dates; record center attestations that a required process was completed on a specific date; display marketplace badges describing the status of those platform processes; and restrict marketplace access when reported information warrants it. These are private platform decisions about marketplace participation. They are not government decisions, not background checks, and not eligibility determinations.

5. What EarlyEd Reserve Cannot Do

EarlyEd Reserve cannot determine, certify, guarantee, or verify that any person is eligible to work in childcare. It cannot access CBCU or any state system. It cannot transfer a determination between operations. It cannot clear any person for any center. No badge, status, score, or profile element on this platform may be represented as a state or government clearance.

6. Prohibited Representations

No user may represent EarlyEd Reserve participation, badges, reviews, or statuses as a government background check, a state eligibility determination, or a transferable clearance. Making such a representation — in a profile, in a posting, in marketing, or in conversation — is a material breach of the applicable agreement and grounds for restriction or removal.

7. No Affiliation

EarlyEd Reserve is not affiliated with, endorsed by, or partnered with HHSC, CBCU, TWC, TEA, DFPS, or the Quad Agency Child Care Initiative. References to Texas programs and agencies are informational only.

8. CBCU Future Integration (Not Active)

EarlyEd Reserve is designed so that a properly authorized agency integration could be added in the future. Agency integration is not currently active. Activation requires written authorization, approved data-sharing terms, security review, testing, and applicable legal approval. Until and unless that occurs, no data is exchanged with any state system, and nothing on this platform should be read as implying otherwise.
